Terms of Service
Last updated: May 2026These terms govern your use of Tårtly. Tårtly operates a marketplace connecting customers with Swedish patisseries (konditoris). When you place an order, your consumer contract is directly with the patisserie that fulfills it; Tårtly acts as marketplace facilitator, not as the seller of the cake.
1. Introduction
Tårtly AB ("Tårtly", "we") operates a digital marketplace where customers can discover, order, and pay for cakes from independent Swedish patisseries. By creating an account or placing an order, you agree to these terms. A note on our role: Tårtly is a marketplace facilitator, not the seller of the cakes. Each patisserie is the seller of record for the cakes they prepare and provide through the platform, in the meaning of the Swedish Consumer Sales Act (Konsumentköplagen).
2. The Service
Tårtly provides: a discovery and ordering platform, payment processing via Stripe, customer support and mediation between customer and patisserie, and marketing for participating patisseries. Tårtly does not provide the cakes themselves — each cake is prepared and sold by the patisserie you order from. Pickup is at the relevant patisserie in Malmö. Home delivery is under evaluation and is not currently offered.
3. User Account
To place an order, you create an account or check out as a guest where supported. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You must be at least 18 years old to place an order. One account per person.
4. Orders and Payment
When you place an order, it is sent to the patisserie for acceptance. A binding contract is formed between you and the patisserie when the patisserie accepts the order. Tårtly is not a party to the consumer sales contract — we act as facilitator and payment recipient on behalf of the patisserie. Prices are shown in Swedish kronor (SEK) including VAT. Payment is taken at order time by card through Stripe. Tårtly does not charge the customer any additional fee beyond the displayed price.
5. Cancellation and Refunds
You may cancel free of charge until the patisserie has started production (status: in production). After that, cancellation is handled case by case — contact us at info@tartly.se and we will mediate. Cakes are custom-made to order and are generally exempt from the right of withdrawal under the Swedish Distance Contracts Act (Distansavtalslagen) Chapter 2 § 11 (custom-made or perishable goods). The protections of the Swedish Consumer Sales Act regarding defective goods are unaffected by this exemption. This draft must be reviewed by a lawyer before publication.
6. Quality and Complaints
The patisserie is the seller of the cake under the Swedish Consumer Sales Act and bears legal responsibility for the quality of the goods, food safety, and conformity with the order. Your rights under the Consumer Sales Act (rectification, replacement, price reduction or rescission in case of defect) apply in full and cannot be contracted away. We recommend you contact us first at info@tartly.se for any issue — we mediate between you and the patisserie. Unresolved disputes may be brought to the Swedish National Board for Consumer Disputes (ARN — Allmänna reklamationsnämnden). Tårtly cooperates with any ARN process.
7. Liability
The patisserie bears consumer-law liability for cake quality, food safety, and contract compliance. Tårtly is responsible for the platform operating within reasonable bounds, payments being processed correctly, and customer support being provided. Neither party is liable for circumstances beyond reasonable control (force majeure). Nothing in these terms limits mandatory consumer rights under Swedish law — if any provision is invalid, it does not affect the remaining terms. This liability section is preliminary and requires legal review.
8. Intellectual Property
The Tårtly name, logo, and platform design belong to Tårtly AB. Cakes, names, photos and descriptions provided by patisseries belong to the respective patisserie; the patisserie grants Tårtly a license to display the content on the platform. Reviews and comments you submit are yours, but you grant Tårtly a non-exclusive right to display them on the platform in connection with the relevant patisserie.
9. Personal Data

10. Changes to These Terms
We may update these terms. For material changes, we will notify you via email or on the platform in reasonable time before the change takes effect. Continued use of the service after a change constitutes acceptance of the updated terms.
11. Applicable Law and Dispute Resolution
Swedish law applies to these terms and to your use of Tårtly. We first try to resolve disputes directly — contact info@tartly.se. Consumer disputes may then be brought to the Swedish National Board for Consumer Disputes (ARN). General courts are the final instance, with Malmö District Court as first instance.
